1. Agreement to Terms
Welcome to 1to10!
These Terms of Service ("Terms") govern your use of the 1to10 mobile application (iOS, Android) and web application (collectively, the "Service" or "App") operated by Marsrock ("we," "us," or "our").
By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility
2.1 Minimum Age
You must be at least 18 years old to use the Service.
Age Verification: You must provide your accurate date of birth during registration. We automatically block accounts under 18 years.
No Exceptions: This age requirement applies globally, regardless of local laws that may permit younger users for other services.
2.2 Account Accuracy
You must provide accurate, current, and complete information during registration and keep your account information updated.
Prohibited:
- Creating multiple accounts
- Impersonating another person
- Using someone else's identity
- Providing false information
Consequence: Account suspension or termination
3. Account Creation & Responsibility
3.1 Account Security
You are responsible for:
- Maintaining confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access (email: info@1to10me.com)
3.2 Authentication Methods
We support the following sign-in methods:
- Google Sign-In (OAuth 2.0)
- Apple Sign-In (OAuth 2.0)
- Magic Link (email-based passwordless authentication)
Security: Never share your login credentials with third parties.
4. Acceptable Use & Community Guidelines
4.1 General Conduct
You agree to use the Service in a respectful, lawful, and appropriate manner.
You agree NOT to:
❌ Upload prohibited content (see Section 4.2)
❌ Harass, bully, or threaten other users
❌ Spam or send unsolicited messages
❌ Impersonate other users or entities
❌ Use bots or automation to manipulate ratings or credits
❌ Reverse engineer or decompile the App
❌ Scrape or harvest user data
❌ Interfere with the Service's operation
❌ Violate any applicable laws or regulations
4.2 Prohibited Content
You may NOT upload, share, or post content that contains:
🚫 Nudity or sexual content (full or partial nudity, sexually suggestive poses)
🚫 NSFW (Not Safe For Work) content
🚫 Minors (anyone under 18 years old)
🚫 Hate speech or discriminatory content (based on race, religion, gender, sexual orientation, disability, etc.)
🚫 Violence or gore (graphic violence, self-harm, animal cruelty)
🚫 Illegal activities (drugs, weapons, illegal services)
🚫 Spam or advertising (promotional content, MLM, scams)
🚫 Copyrighted material (without permission)
🚫 Private information (doxxing, personal data of others)
Examples of acceptable photos:
✅ Clear, well-lit headshots or portraits
✅ Casual selfies
✅ Photos showing your face clearly
✅ Appropriate group photos (with consent of others)
4.3 Content Moderation
We reserve the right to:
- Review all uploaded content (automated & manual review)
- Remove content that violates these Terms without notice
- Suspend or terminate accounts for violations
- Report illegal content to law enforcement
Automated Moderation: We may use AI tools (e.g., Google Cloud Vision API) to detect prohibited content.
Response Time: We aim to review reported content within 24-48 hours.
4.4 Reporting System
How to report inappropriate content:
- In-App: Tap "Report" button on any photo or comment
- Email: info@1to10me.com with subject "Content Report"
Categories:
- NSFW/Inappropriate
- Hate Speech
- Harassment
- Spam
- Copyright Violation
- Other
What happens:
- We review the report within 24-48 hours
- If violation confirmed: Content removed + warning to user
- Repeated violations: Account suspension or termination
- Serious violations (illegal content, minors): Immediate account termination
4.5 Appeal Process
If your content was removed or account suspended:
- Email info@1to10me.com with subject "Appeal - Content Removal"
- Explain why you believe the removal was incorrect
- Provide any relevant context
Review Time: 7 business days
Decision: Final and binding
Note: Repeated frivolous appeals may result in account termination
5. User-Generated Content
5.1 Your Content Ownership
You retain ownership of all photos, ratings, and comments you create ("Your Content").
5.2 License to 1to10
By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Display Your Content to other users within the App
- Store Your Content on our servers (Firebase Storage)
- Process Your Content for app functionality (e.g., image compression, geolocation tagging)
- Distribute Your Content to users based on your targeting settings
- Create derivatives (e.g., thumbnails, compressed versions)
Duration: This license ends when you delete Your Content or close your account.
Exception: Anonymized ratings and comments may remain for platform integrity.
5.3 Your Responsibilities
You represent and warrant that:
- You own or have permission to upload Your Content
- Your Content does not violate any third-party rights (copyright, trademark, privacy, publicity)
- Your Content complies with these Terms and our Community Guidelines
Indemnification: You agree to indemnify and hold us harmless from any claims arising from Your Content.
5.4 DMCA Copyright Policy
If you believe your copyright has been infringed:
- Email info@1to10me.com with subject "DMCA Takedown Notice"
- Include:
- Description of copyrighted work
- URL of infringing content in the App
- Your contact information
- Statement of good faith belief
- Statement of accuracy under penalty of perjury
- Your physical or electronic signature
Response Time: 48-72 hours
Counter-Notice: If your content was removed, you may submit a counter-notice if you believe the removal was erroneous.
6. Credits & Wallet System
6.1 Credit Types
Earned Credits:
- How to earn: Rate other users' photos (1 credit per rating)
- Comment Bonus: Earn additional credits for writing comments (amount varies)
- Daily Limit: 50 earned credits per day (may be adjusted)
- Expiry: 48 hours from earning date
- Non-transferable: Cannot be gifted or sold
Purchased Credits:
- How to purchase: Via in-app purchase (Apple App Store or Google Play Store)
- Available Packages: 50, 150, 500 credits (prices vary by region)
- Expiry: No expiration date (valid until used or account deletion)
- Non-refundable: Once used (see Section 6.4 for refund policy)
6.2 Credit Usage
Photo Uploads Cost Credits:
- Formula:
maxRatings × 10 credits - Example: Requesting 10 ratings = 100 credits
- Premium Users: Can set maxRatings up to their limit
- Free Users: Minimum 1 rating per photo (10 credits)
Important: Once uploaded, your photo remains visible until maxRatings is reached, regardless of your remaining credits. Credits are only required for the initial upload.
Spending Priority:
- Earned credits used first (FIFO - First In, First Out)
- Purchased credits used after earned credits depleted
6.3 Credit Expiry
Earned Credits:
- Automatically expire 48 hours after earning
- Tracked via "earned batches" system
- No refunds or extensions
Purchased Credits:
- No expiration date
- Valid until used or account deletion
- No refunds after use (see Section 6.4)
6.4 Refund Policy
Earned Credits:
- Not refundable (free, time-limited by design)
Purchased Credits:
- Before use: Refunds handled by Apple App Store or Google Play Store (contact their support)
- After use: No refunds (digital goods consumed)
- Exceptions: Technical errors on our end (contact info@1to10me.com)
We do not control refunds. Apple and Google manage all payment processing. Submit refund requests through your App Store or Play Store account.
6.5 RevenueCat Processing
- Purchase confirmations are processed via RevenueCat webhooks
- Delay: Up to 1 hour for credits to appear (usually instant)
- Support: If credits don't appear after 24 hours, contact info@1to10me.com
7. Premium Subscriptions
7.1 Subscription Plans
Available Plans:
- Premium Weekly
- Premium Monthly
- Premium Yearly
Prices: Vary by region and currency (shown in-app)
7.2 Premium Features
✨ 5 active photos (instead of 1 for free users)
✨ Advanced targeting options (geographic, demographic)
✨ Travel Mode (expand or restrict targeting area)
✨ No ads (ad-free experience)
✨ Priority placement (photos shown more frequently)
✨ Premium badge (visible on your profile)
7.3 Billing & Renewal
Billing: Charged through Apple App Store or Google Play Store
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel.
Cancellation: You can cancel anytime in:
- iOS: Settings → Apple ID → Subscriptions → 1to10 → Cancel
- Android: Play Store → Subscriptions → 1to10 → Cancel
Access After Cancellation: You retain premium features until the end of the current billing period.
No Refunds for Unused Time: If you cancel mid-period, you will not receive a prorated refund.
7.4 Price Changes
We may change subscription prices at any time.
Notice: We will notify you 30 days in advance of any price increase
Opt-Out: You may cancel your subscription before the price increase takes effect
Existing Subscribers: Price changes apply at your next renewal date
7.5 Free Trials
If we offer a free trial:
- Auto-Convert: Trial automatically converts to paid subscription unless you cancel
- Cancellation: You can cancel during the trial period to avoid charges
- One-Time: Free trials are limited to one per user
7.6 Refunds (Subscriptions)
Managed by Apple/Google:
- We do not process refunds directly
- Submit refund requests through App Store or Play Store
- Contact Apple/Google support for refund policies
EU Right of Withdrawal:
- 14-day withdrawal right applies to digital content
- Waived if you explicitly consent to immediate access (which you do by using premium features)
7.7 Subscription Termination by Us
We may terminate your premium subscription if:
- You violate these Terms
- Your account is suspended or terminated
- You engage in fraudulent activity
Effect: No refund for remaining subscription period
8. Purchases & Payments
8.1 Payment Processing
All payments are processed by:
- Apple App Store (iOS)
- Google Play Store (Android)
We do NOT:
- Store your payment card information
- Have access to your payment methods
- Process refunds directly
Billing Questions: Contact Apple or Google support
8.2 Taxes
Prices displayed in the App:
- May include VAT/sales tax (varies by region)
- Are shown in your local currency
- Are final (no hidden fees)
Tax Invoices: Provided by Apple/Google (not by us)
8.3 Currency & Regional Pricing
Prices vary by country and are set by Apple/Google based on local market conditions.
9. Service Availability & Changes
9.1 Availability
Best-Effort Service: We strive to keep the Service available 24/7, but we do not guarantee uninterrupted access.
Maintenance Windows: Scheduled maintenance will be announced in advance (when possible)
No SLA: We do not provide Service Level Agreements
9.2 Changes to the Service
We reserve the right to:
- Modify features at any time
- Add or remove functionality
- Change the appearance or design
- Discontinue the Service entirely
Notice: We will notify you of material changes via in-app notification or email
9.3 Service Discontinuation
If we discontinue the Service:
- Notice: 30 days advance notice (if feasible)
- Refunds: Prorated refunds for active subscriptions (via Apple/Google)
- Data Export: You will have 30 days to export your data
10. Prohibited Uses
You agree NOT to use the Service to:
🚫 Violate any laws (local, national, or international)
🚫 Infringe intellectual property rights
🚫 Upload malware, viruses, or malicious code
🚫 Attempt to gain unauthorized access to our systems
🚫 Interfere with other users' use of the Service
🚫 Collect or harvest user data (scraping, bots)
🚫 Sell, trade, or transfer your account
🚫 Create accounts for commercial purposes (without written permission)
🚫 Use the Service for advertising or promotion of third-party services
11. Content Ownership & Licensing
11.1 Our Content
All content provided by 1to10 (app design, code, logos, trademarks, documentation) is owned by Marsrock and protected by copyright, trademark, and other intellectual property laws.
You may NOT:
- Copy, modify, or distribute our content
- Reverse engineer the App
- Remove or alter copyright notices
- Use our trademarks without written permission
11.2 User-Generated Content
See Section 5 above.
11.3 Third-Party Content
Some features may display content from third parties (e.g., Google Maps). Such content is subject to the third party's terms and licenses.
12. Account Termination
12.1 Termination by You
You may close your account at any time:
- In-App: Profile Settings → Delete Account
- Email: info@1to10me.com with subject "Delete Account"
Effect:
- Account permanently deleted within 30 days
- Photos removed from storage
- Ratings anonymized (no longer linked to you)
- Purchased credits forfeited (no refund)
- Premium subscription cancelled (no prorated refund)
12.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms
- Upload prohibited content
- Engage in abusive behavior
- Use automated tools (bots) to manipulate the Service
- Have an inactive account (24 months of no activity)
Notice: We will notify you via email before termination (except for serious violations)
Appeal: Email info@1to10me.com within 14 days to appeal a suspension
Effect:
- Immediate loss of access
- No refund for purchased credits or active subscriptions
- Ratings and comments remain (anonymized)
12.3 Survival
Sections that should survive termination: Sections 5 (Licensing), 13 (Warranty Disclaimer), 14 (Limitation of Liability), and 16 (Dispute Resolution).
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of content
- Uninterrupted or error-free operation
User-Generated Content: We do not endorse, guarantee, or verify the accuracy of ratings, comments, or photos uploaded by users.
Quality of Ratings: We cannot guarantee the quality, accuracy, or authenticity of ratings you receive.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
14.1 Exclusion of Damages
We are NOT liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or goodwill
- Service interruptions or errors
- User-generated content (ratings, comments, photos)
- Third-party actions (other users, service providers)
14.2 Liability Cap
Maximum Liability: Our total liability to you for any claim is limited to the greater of:
- €100 EUR, or
- The amount you paid us in the 12 months prior to the claim
14.3 Exceptions (Germany/EU)
This limitation does not apply to:
- Intentional misconduct (Vorsatz)
- Gross negligence (grobe Fahrlässigkeit)
- Personal injury (Körperverletzung)
- Liability under mandatory consumer protection laws
15. Indemnification
You agree to indemnify, defend, and hold harmless Marsrock, its affiliates, and service providers from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content
Example: If someone sues us because you uploaded their copyrighted photo, you agree to cover our legal costs.
16. Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of Germany, without regard to conflict of law principles.
16.2 Jurisdiction
Primary Jurisdiction: Courts of Munich, Germany
Exception for Consumers: If you are a consumer in the EU, you may also bring claims in your country of residence (as protected by EU consumer law).
16.3 ODR Platform (EU)
The European Commission provides an Online Dispute Resolution platform:

16.4 Informal Resolution
Before filing a lawsuit, please contact us at info@1to10me.com to resolve the dispute informally. We commit to good-faith efforts to resolve disputes within 30 days.
17. Changes to Terms
17.1 Modification Right
We reserve the right to modify these Terms at any time.
Notice: We will notify you of material changes via:
- In-app notification
- Email to your registered address
- Updated "Last Updated" date at the top of this document
Review Period: 30 days before changes take effect
Acceptance: Continued use of the Service after changes constitutes acceptance
Rejection: If you do not agree to the changes, you must stop using the Service and delete your account
17.2 Version History
Previous versions of these Terms are available upon request (email info@1to10me.com).
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Marsrock.
18.2 Severability (Salvatorische Klausel)
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
18.4 Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
18.5 Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, war, pandemics, government actions, internet outages).
18.6 Language
English Version: Authoritative
Translations: Provided for convenience; in case of conflicts, the English version prevails

Your use of the App downloaded from Apple App Store or Google Play Store is also subject to their respective Terms of Service:
